The Forces Against the Development of An Independent Judiciary in Haiti by Èzili Dantò, September 1995The HLLN 1995 Haiti Judicial Reform position paper is copied in pdf form below.
I was recently re-reading this position paper I wrote 21-years ago as a young lawyer. It was in 1994-1995. (My name then was a French colonized person's name, Marguerite Laurent. Only family and art colleagues called me Èzili back then.)
It was the year I founded the Haitian Lawyers Leadership Network to institutionalized the rule of law in Haiti and to protect the civil, economic, human and cultural rights of Haitians living at home and abroad.
That year in Haiti I was an attorney for the first democratically elected Haitian president, Jean Bertrand Aristide and, for important reasons I won't go into right now, I was working at the Ministry of Justice as the Coordinator of Donor Funds for Judicial Reform Projects.
Lifetimes have gone by.
Read the paper and see part of that journey and how disturbing it is for me to write this last position statement for HLLN where HLLN strongly denounces the disputed Parliament and this masquerade of a provisional president. Many will also recall the tireless efforts of HLLN, from 2004 to 2006 to get then Minister Jocelerme Privert and other Lavalas officials illegally imprisoned, released. In 1995, HLLN and I were kicked out of Haiti by the U.S. ambassador to Haiti for, what the person who was there and who just sent me this 21-year old position paper, says was my " clarity of vision and grasp and knowledge of geopolitics" that I'd exposed while in Haiti.
The position paper I wrote back then for HLLN expressed the details of my experiences in Haiti in 1994-1995. I was reviled then by the status quo for standing against the injustices metered out to Lavalas Movement militants.
Back then, as now a hit was put on my life. I always feel them when they're close. But back then, Empire and their coup d'etat bullets riddled the hotel room I was supposed to be in. I haven't spoken much about this in two decades. Moreover, 22-years ago, as today, my knowledge of geopolitics balanced with Haiti art, spirituality, dance and life unnerved the powers-that-be. I do feel my time on this battlefield coming to an end. If for nothing else than the sheer boredom of Empire's template and the educated Haitians constantly letting themselves get played. This is not what I came to witness.
I share the paper written in 1995 because it's timely. You'll notice what's changed and stayed the same.
Ironically, I naively presented it at a Brookings Institute event on Haiti held in Puerto Rico. They were not welcoming.
This is a draft, but the corrected original wasn't much different. I have it somewhere in storage boxes. Just as I have, somewhere in a storage box, the letter that was drafted by the current UN MINUSTAH deputy director, "Brotherman DOJ" Carl Alexander (- then also a member of HLLN who I didn't suspect of malfeasance until it was too late).
I am told he drafted it for the signature of the then US Ambassador to Haiti, Larry Swing, kicking me out of Haiti to put the Chemonic ilks in as judicial reformer. (See, SELF-DEFENSE IS THE ART OF DODGING.)

The Jan 7, 2016 Martelly Decree to make a Labadie out of La Gonave, apartheid walls and all to be guarded most likely by HSLI, the Israeli contractors Martelly-Paul regime signed a $50 million dollar contract with to "monitor" all Haiti borders, land air and sea!

F olks, we covered this effort to take LaGonave before. I haven't had time to research the old links but here's their colonial vision for La Gonave. Send us more information if you have it. From what I can gather the January 7, 2016 decree creates an extra territorial zone at La Gonave thus making this space a kind of tax free zone for national and international financial activities : a tax haven managed by state company which will not apply by Haitian fiscal laws. This will essentially not be a Haitian territory ruled by Haitians but by the foreign thieves, banksters and oligarchs. A multinational territory apparently signed by the Martelly regime ministers. This is another chaos left by the internationals to engage all our energies while the thieves take more of Haiti riches and lands behind the scene.
Haiti needs to shut down the country and stop all activity unless it's about giving the people food, sanitation, clean water, electricity and a means for dignity. The Jan 7th decree is another very dangerous precedent. It creates the conditions for high-intensity money laundering while creating the possibility for the tiny global oligarchic elite companies not to pay tax at all in Haiti through a subsidiary with a strategy parent company based in the Haitian tax haven.
This has NOTHING to do with local development, food sovereignty for the masses or protection of the lands the Ancestors left to us after 300 years of European enslavement, the Haiti revolution, or the price generations after generations of Haitians have paid after independence for 212 years to hold our lands. Haiti has paid 122 years of an Independence Debt we didn't owe to France, and then the US took our gold reserve and put us, since 1914 on their currency, destroying Haiti-backed monies. Now they use unelected Michel Martelly to sign off the taking of Haiti lands and islands that's been paid for by Black Haiti a thousand times over. All who signed this decree while the people where protesting Martelly's corruption and legitimacy are suspect and must account to Desalin's children. Bagay sa yo pap pase ditou.

In our last post, we explained why we did not want the Senate president to convene the national assembly. (Read, Haiti's David and Goliath Battle for Democracy Against U.S.-supported Dictatorship and Monopoly Capitalism.) This European Parliamentary format historically is the regency that maintains the monarchy and the Bank of International Settlements, not the majority voices.
Yesterday the Senate head, Jocelerme Privert tried to cut the people's throat. He convened the illegally elected Parliament, seating wrongfully and duly elected Deputies and Senators, together as one. This attempts to erase the protester's gains against the fraudulent presidential, local and parliamentary elections on August 9 and October 25, 2015. Many of these Parliament members bought their post for money during the sham 2015 elections. Now the talk is of either Privert or the head of the Supreme Court (Jules Cantave?) being appointed as provisional president who will name a consensus provisional Prime Minister until fair elections are held.
Here's the rub: the Euros kept their illegal, fraudulently elected parliament to use over the people's wishes. Pierre Opont, the corrupt electoral council president's last piece of garbage thrown at Haiti will hurt like hell and for more than five years no matter who becomes president, unless this fraudulent parliament is neutralize, goes unrecognized, are investigated and the ill elected ones decertified by an honest electoral council.
The Ezili Network/Free Haiti are made up of the finest Haiti minds. What's our next play folks to help neutralize this illegal Parliament? To help give the pro-democracy sectors room to set up a proper transitional government that will sort out the Parliamentary and presidential vote and elections? This illegal Privet/PHTK/KID Parliament is about to vote away Haiti RICHES to the CORE GROUP. That's what Opont/US-EU put them in there to do. Stopping the election on Jan 24th was a battle we won. But the war is for Haiti's riches and the Internationals have sic Parliament on us to vote to approve the new World Bank mining laws; to vote to amend the Haiti Constitution written by the World Bank. The CORE Group basically sneaked the Parliament in with a wink that said - "we know you guys are illegal. But the G8 won't be bought off. We won't say anything about your illegality. But as Parliament, you have to vote the World Bank mining amendment; you have to vote to confirm WB Constitutional amendment; you have to vote to approve all of Martelly's illegal decrees." Do not be surprised if at the last hour, this illegal CORE-Group Parliament, at least the Deputy Chamber filled with Martelly party Deputies, votes to extend Martelly's term until May 14, 2016. Do not be surprised if the US Southern Military Command lands in Haiti with a marine unit under the pretext "to make sure Martelly leaves and to protect US citizens." How convenient. The US-EUs illegally imposed Michel Martelly in 2010 to legitimize stealing from Haiti. And in 2016, they'll bring in more invaders saying it's to insure their stooge leaves when his term is over this Sunday, Feb 7th. But really, when has the US ever fully done a solid for Black Haiti? Further interventions, besides their UN front, already on the ground in Haiti for twelve years, is to guarantee Martelly's replacement is another US-stooge. Even if they're not brazen enough to do this, the Internationals have put a hornet nest of fraudulently elected people in our faces so that Empire may continue to have a reason to be in Haiti, make money with private military security contractors, keep the bogus narrative about the incompetent and divided Haitians who can't rule themselves, going on... The U.S. State Department is dead set on ramming an illegitimate president and an illegitimate parliament into office in Haiti, which will bring more protests. That way the malevolent OAS, UN, EU Internationals and their corporate media may have a pretext for more unwanted interventions and racism in Haiti.
It's tragic. Today, Friday, February 5, 2016, men on motorcycles wearing former Haiti army military fatigue are roaming the streets, some shooting and attacking anti-Martelly dictatorship citizens. One was stoned by the crowd near Maxon. Allegedly he shot at the crowd and they caught him. It's ugly stuff. Word in the street is as of tonight all illegal weapons are legal. Calmer minds must prevail. Most people are saying the army people are just buffoons seeking attention. They say they won't let the Makouts kill them as the UN-Euro give them firepower cover - that "2016 is not 2004!"
The Internationals need to back-off with their former Haiti military. Martelly must go without leaving his Duvalierist/Core Group remains behind. This Haitian blood in on the hands of the Clintons, Obama, Kenneth Merten, and the Paul Farmer NGOs that gave them the PR to illegally put in another Duvalierist Martelly. They are our past, not the future.
Reports are that the people came under heavy gun fire at Champs de Mars.
Near Avenue Magloire Ambroise, there's a grey pick up truck filled with the special police unit known as CIMO. The CIMO truckloads of militarized police are just watching the violence against unarmed people and doing nothing to chase the motorcycle militias or to arrest them. The motorcycle militias are part of the old Armed Forces of Haiti (FAHD/Makoutes) and the new ones were trained in Ecuador for Martelly. The rumor is they are headed to the national palace. If the past is prologue. The status quo will continue to ramp up their militarized police force and Guy Philippe-like paramilitary. Continue to kill, incarcerate, terrorize and beat up the anti-corruption protesters in order to demobilize, make fearful and scatter the people into silence. What can peaceful people with integrity do to save some Haiti lives from the wrath of the rabid elites and their overseers? One is the jockeying for the U.S. presidency.

Give the Clintons their piece of change back. Donald Trump, (who along with Hillary Clinton is the lowest common denominator in Western "civilization") will probably be the next U.S. president. But the US electorate is nowhere as educated about their farcical elections as the Haitian on the streets these last five years against Martelly are. The wealthiest, most "educated" population on the planet, generally has no clue that the Democrats are lethal to the common man, even more so than the Republicans and the whole shebang must go! They don't know that Obama's War Against the First Black Republic is unspeakable. I've said this before and say it again: Give me the KKK, the ultra right skinheads, the Neocons before any of these sniveling emotional Democrats in need of a pat in the back from their victims while they rape you senseless. At least the Republicans honestly want a separation. I'm down with separating from neanderthals. All for it.
Let's play the Republicans with promise of the Diaspora vote and buy room to renegotiate better use of Haiti human and natural resources. I mean really. There's no use trying to convince Haitians in the US not to vote. That's as much of a losing battle as asking local Black Americans to remember how Obama ignored them or the crimes of the Clintons or Bill's prison industrial complex, et al. Serious revelations in the Daily Star: 600 British soldiers train Daech (Islamic state) terrorists

These facts once again demonstrate the direct involvement of Western intelligence agencies in encouraging Islamic terrorism worldwide.

Le groupe des candidats à la Présidence engagés dans le processus électoral communément appelé Groupe des 8 (G-8), après de nombreuses rencontres avec différents secteurs de la vie nationale, renouvelle sa proposition de sortie de crise passant par :
1) La mise en place d’un Président Provisoire issu de la Cour de Cassation de la République ;
2) Un Premier Ministre de consensus issu du secteur Politique ;
3) Un Gouvernement issu de la classe politique et des autres secteurs vitaux de la vie nationale.
Le G-8 rappelle que la mission principale du gouvernement provisoire consistera à mettre en place une Commission d’Enquête et de Vérification Electorale chargée de restituer la sincérité du scrutin.
Le G-8 met en garde contre toute velléité de confusion des pouvoirs, de non-respect du principe élémentaire de séparation des pouvoirs susceptible d’aggraver la crise et condamne les manœuvres politiciennes tendant à semer la discorde, la division au profit des ennemis du peuple.
